President Donald Trump signed the memo on September 9th to increase enforcement action against businesses that use drug ads aimed at consumers and do not properly disclose side effects from drugs.

According to senior White House officials, the ads have broken into social media without proper disclosure with many online pharmacies who do not follow the same rules that many pharmaceutical companies follow.

“My administration ensures that the current regulatory framework for drug advertising provides fair, balanced and complete information for American consumers,” the memo says.

Enforcement has also declined over the years, with no letters being sent last year, officials said.

The administration will also assume social media companies and social media influencers who are paid to promote medicines without following the same rules that pharmaceutical companies adhere to.

“We’re where we spend 20 to 25% on budget marketing and advertising, and the majority of that is advertising,” said a senior White House official. “I would like to ask these companies to spend 20-25% of the budget for these advertising to lower drug prices for everyday Americans.

The administration will also consider closing “appropriate clause loopholes” that allow pharmaceutical companies to omit a comprehensive list of any side effects.

The loophole says companies are posting side effects and potential harms elsewhere, on websites, and on prints, and referring people to other sources to get complete information.
