Fed pursues death penalty in Vermont Border Patrol shooting: lawyer

Federal prosecutors appear to be preparing to seek the death penalty for a woman accused of shooting by the U.S. Border Patrol near the Canadian border, and her lawyers are asking judges to delay the process.

The Attorney for Teresa Young Brute complained in a June 30th court filing in Vermont that prosecutors are pushing for an unusually offensive timeline for filing death penalty cases. They say the rush to judges violates their right to investigate the mitigation situation.

“This court should intervene to ensure that Miss Young Brute receives a meaningful opportunity to persuade the government not to pursue the death penalty,” her lawyer said in a court filing.

In February, Attorney General Pam Bondy picked up the Young Brute case as a classic example of the Trump administration’s offensive sought the death penalty. Bondi said the Trump administration has pledged to seek prompt justice in regards to capital murder cases and ordered staff to reconsider past “no-seek” decisions that federal prosecutors had sought the death penalty but did not.

“From now on, the Department of Justice will act again as a law request, including seeking death penalty sentences when appropriate and expediting those sentences in accordance with the law,” Bondy said.

What happened on January 20th?

Authorities say Young Brute and his companion pulled a gun at Border Patrol agents during a traffic stop on January 20th. YoungBlut has not yet been specifically charged with firing a fatal shot and has not been formally notified that she is facing the death penalty.

The conflict between YoungBlut and Maland appears to be linked to a series of deaths across the country related to the cult “Zizan” group, which are also being investigated in California, Maryland and Pennsylvania. YoungBlut’s lawyers said it would take more time to hold the actual trial, and YoungBlut’s lawyers said the process of determining whether the Internal Justice Department seeks the death penalty will take more than a year.

Youngblut’s lawyer also argues in her life that she has the right to investigate situations that will legally ease more time. Court records note that YoungBlut’s diary contains several references to taking LSD.

Ophelia Bauckholt, a German national traveling with Youngblut, was also killed in a shootout with a federal agent.

The two initially attracted the attention of law enforcement as Young Brute and Buckholt wore tactical style gear and were reported to openly carry legal but rare firearms in Vermont. According to the affidavit, the two refused to speak to the officers, and the agents began chasing after them.

Investigators also mistakenly assumed that Buckholt’s visa had expired by mistake if it would remain in the US.

According to court records and an FBI affidavit, minutes after Border Patrol agents stopped the Toyota Prius, which Young Brute was driving, Young Brute fired with a handgun and fired at least two shots. The backholt, which also painted a handgun, was shot before it could be fired. Bauckholt died at the scene, and Maland, a Border Patrol agent, died at a nearby hospital.

Investigators said they found five cell phones, a night vision device and a laptop in the Prius.

Earlier this month, the large ju judge indicted Jack “Jiz” Lasota, named after the Gigian Group, on weapons charges. According to court records, the man Youngblatt planned to marry was arrested on January 24 in connection with the January 17 murder of a California landlord.

A longtime Vermont defense attorney who is well-versed in the case told USA Today he previously believed Youngblatt fired fire on Border Patrol agents because he thought he knew about the California murder that took place three days ago.
