President Donald Trump is seeking $230 million in damages from the Justice Department for investigations and charges filed before he returned to the White House, according to the New York Times.

The complaint focuses on a classified documents case related to the 2016 Russian election interference investigation and the FBI raid on a Mar-a-Lago mansion, the newspaper said.

“I know that decision has to come to my desk, but it’s very strange for me to make a decision when I’m paying for it myself,” Trump said in the Oval Office on October 21. “But I’ve suffered a lot of damage…and I’m going to donate the money I get to charity.”

Trump is named as a defendant in more cases than he is reportedly named in his complaint. Here’s what you need to know:

How many felonies does Donald Trump have?

Trump was found guilty by a New York jury in May 2024 of 34 counts of falsifying business records, a historic development for the former president who would go on to win the election just months later. In the hush-money case in which Trump was convicted, he was sentenced to “unconditional release,” meaning he will receive no prison time or probation. President Trump has attempted to appeal the case by moving it to federal court, but CNN reported that similar efforts have failed in the past.

Although calling someone a “felon” is considered an outdated term, President Trump’s felony conviction has not yet been expunged by appeal or reversal.

Can President Trump pardon his own felonies?

President Trump cannot pardon himself in the hush-money case because presidential pardon power only applies to federal cases. His felony conviction resulted from a New York state lawsuit.

What is the Justice Department’s $230 million case about?

According to the New York Times, Trump filed his complaint through two allegations:

  • In 2023, he claimed his rights were violated during an investigation into Russian election interference and possible ties to the 2016 Trump campaign.
  • Another complaint in the summer of 2024 focused on the classified documents case, accusing the FBI of violating privacy in the Mar-a-Lago attack and the Justice Department of malicious prosecution.

The classified documents case was one of two federal cases that were dropped in line with the Justice Department’s long-standing policy of not prosecuting sitting presidents. Trump’s other criminal case in Georgia suffered significant delays after a state appeals court disqualified him as district attorney.
