Shawn “Diddy” Combs failed to overturn his beliefs prior to his sentence in a federal sex crimes case.
Combs’ legal team previously filed a motion to Judge Arun Subramanian to overturn criminal convictions for two modes of transportation to engage in prostitution or allow a new trial. According to court documents obtained by USA Today, the court rejected both claims in its opinion filed Tuesday, September 30th.
The Subramanians refused to defence attempts to narrow down the definition of “prostitution” he was convicted of, and prosecutors refused their argument that they had not presented enough de facto evidence to prove that combs was specifically transporting people for sexual payments. The judge called out the prosecution’s evidence, including testimony that the escort was “paid thousands of dollars… to have sex,” a woman identified as Cathy Ventura and “Jane,” a “overwhelming” person.
“The correct definition of prostitution in Man’s law is sex in exchange for money or equivalent,” writes Subramanian. “The government of the trial has presented overwhelming evidence of Mann’s guilt on many occasions, both with regard to Ventura and Jane.”
Regarding Combs’ new trial demands, his team is claiming evidence presented at the trial for more serious charges. The Subramanian also rejected the argument, saying “Kone cannot carry his “heavy burden” of showing “spillover prejudice.”
When is Didi’s verdict date?
On July 2nd, the fighting music mogul was acquitted of his most serious assault conspiracy and sex trafficking charges, and was convicted of a small number of transports engaged in prostitution charges in a bomb split decision. He is ready to issue his sentence on Friday, October 3rd.
Combs’ team recommends handing over Subramanians for 14 months’ prison hours while prosecutors seek 11 years’ sentence.
