Biden defends the frequent use of autopen: “I made all the decisions.”

WASHINGTON – Former President Joe Biden said that all pardons and commutes he issued in the final months of his term were his decisions and called Republicans a “liar” for claiming that he was neutralised when his aides used a signing device to sign off documents.

Biden’s comments, made in a 10-minute interview with the New York Times published on July 13, showed his most powerful response to allegations that the Biden White House granted leniency without the president’s approval. Probes from Republican enemies of the Trump White House, the Justice Department and Congress are investigating the issue.

“I made every decision,” Biden said in an interview, recreating his signature due to the vast amount of generous behavior towards people in a wide range of categories, including non-violent drug offenders. “We’re talking about a lot of people.”

Biden cut the sentences for nearly 4,000 federal prisoners in the final months of his presidency and issued preemptive pardons to potential Trump targets, including former chairman of the Joint Chief of Staff General Mark Millie and members of Biden’s family. Biden’s son, Hunter Biden, was the only generous warrant recipient that Biden signed by hand during this period.

“As you know, the autopen is legal. As you know, other presidents used it, including Trump,” Biden said, according to an excerpt from an interview released by The Times. “They’re liars,” Biden said when asked about Republicans’ claims that his White House had abused the autopen.

“They have lied very consistently about almost everything they do. The best they can do is try to change focus and focus on something else,” the former president said. “That’s consistent with Trump’s game plan all along.”

Biden dropped out of the 2024 election in July of that year after struggling to piece together consistent texts during his discussion with Trump the previous month. In May this year, Biden was diagnosed with an aggressive form of prostate cancer.

Trump and fellow Republicans have proposed without evidence that Biden’s aides illegally used autopen, claiming that the former president cannot make generous decisions himself due to reduced mental fitness.

“I think it’s the biggest scandal in this country in the last 100 years,” Trump said last month days after ordering the Justice Department to decide who should apply Biden’s signature to generous documents.

“I don’t think he knew,” Trump said on July 14th. “I don’t think they’ve even told him about it.”

According to the New York Times, the Biden White House followed the process to establish that the president signed a verbal and generous decision before using the signing device. Stephanie Feldman, who served as White House secretary under Biden, controlled the use of the autopen. The Times highlighted an email among Biden officials who support such a process being implemented.

Biden did not individually approve each name included in the broader generous action applied to a large classification of people, aide Biden told the Times. The former president instead approved the standard to determine which prisoners should cut sentences.

Harrison Fields, the Trump White House deputy reporter general, said in a statement to USA Today when asked in an interview to respond to Biden’s claims, Biden “should not be trusted again.”

“Just the truth emerges about Joe Biden’s cognitive and physical health conditions, and in fact, the truth about who runs the country sooner or later will be revealed,” Fields said.

In December 2024, Biden notified the sentences of nearly 1,500 people placed in home confinement during the Covid-19 pandemic, and forgived 39 people convicted of non-violent crimes. The following month he notified 2,500 criminal sentences for a non-violent drug crime that he described as “disproportionately long” compared to modern writing.

Also, in December 2024, Biden issued an individual preemptive pardon to forgive Hunter Biden for a felony of guns and taxes and protect him from future charges by Trump. On his final day of office, Biden issued a similar preemptive pardon for his brother James Biden and other relatives, as well as individuals who considered Miley’s potential targets.

A former Biden aide has been summoned to Congress as part of the Biden-led House Oversight Committee’s investigation into Biden’s mental fitness and his autopen.

Last week, Biden’s former White House doctor, Dr. Kevin O’Connor, called out Fifth Amendment rights, citing the confidentiality of the doctor and client, and refused to answer a series of questions from Republicans on the committee during a closed deposition.

Former Biden aide Ashley Williamson appeared for deposit on July 11th. Neela Tanden, former Biden’s former domestic policy aide, first testified last month about autopen substances. The committee also issued a subpoena to Anthony Vernal, former First Lady Jill Biden adviser and senior adviser to First Lady Jill Biden, for appearances in the deposit on July 16th.
