Sen. Mark Kelly under Pentagon investigation

Kelly, a Democrat from Arizona, is one of several lawmakers who appeared in a video calling on the U.S. military to refuse illegal orders.

The U.S. Department of the Army announced on November 24 that the Pentagon is investigating “serious allegations of misconduct” by Sen. Mark Kelly.

A “thorough review” of the allegations has begun to determine further action against the retired U.S. Navy captain, which “could include return to active duty for court-martial or administrative action,” the agency said in a post on X.

According to the post, authorities are investigating whether the Arizona senator was involved in any violation of military law. The move came after Kelly, along with several other lawmakers, called on the U.S. military in a video to reject illegal orders.

In a social media post, he cited a federal law that allows veterans to be recalled to active duty if ordered to do so.

“The Department of the Army reminds all individuals that veterans remain subject to the (Uniform Code of Military Justice) for applicable crimes and that federal law prohibits conduct intended to disrupt the loyalty or morale of the military, or good order and discipline in the military,” the post said. “Any violations will be addressed through appropriate legal channels.”

The agency said it would not release any further information because the investigation is ongoing.
