The decision of US District Judge Charles Breyer comes after President Trump deployed National Guard troops and Marines in Los Angeles during a violent protest against immigration enforcement.

Currently, National Guard forces carry weapons in DC as Trump shows possible deployments to other democratically driven cities.
A federal judge has thwarted President Donald Trump from deploying the California National Guard based on the “continued risk” of the president acting illegally.
San Francisco US District Judge Charles Breyer wrote on September 2 that Congress was evident in the Comittatas Act of the 1878 rally, which Congress banned using the US military for domestic law enforcement.
However, he determined that there was no rebellion when Trump deployed the National Guard and Marines in Los Angeles in June, ostensibly suppressing the rebellion and ensuring that immigration laws were in effect. Breyer cited plans by Trump and Defense Secretary Pete Hegses to expand the guard deployment in Oakland and San Francisco.
“But there was no uprising, and civil law enforcement agencies were unable to respond to the protests and enforce the law,” Breyer wrote. “The evidence at the trial established that defendants used military vehicles with the defendants (the protective armor often obscure their identity) to set up protective perimeters and traffic blockades, engage in crowd control, and demonstrate military presence around Los Angeles.
The federal appeals court decided in June that Trump could continue to control the National Guard after a previous ruling from Breyer that he illegally deployed the National Guard.
9 Three Judges Panelth The U.S. Circuit Court of Appeals found Trump could maintain control over the California State Guard, and Democratic government Gavin Newsom pursued a lawsuit against the development.
The incident is closely monitored as Trump mobilized the National Guard in Washington, D.C. separately and threatened to bring troops to Chicago and other cities. Trump’s authority to use security guards in Washington is unique as it is a federal seat, but Chicago Mayor Brandon Johnson called his city’s threatened moves “tyranny.”
Trump deployed the National Guard in Los Angeles in June during a period of occasional violent protests against federal immigration enforcement agents. Newsom and Mayor Karen Bass said there is no emergency justifying the military.
“The verdict is clear. Trump is breaking the law by trying to create a national police force with himself as chief,” Newsom said in a social media post.
The three-day trial for Breyer, which ended August 13, focused on what the military did in supporting immigration and customs enforcement agencies and other law enforcement agencies.
Attorneys for the state Attorney General’s Office alleged that the military performed police functions by setting security boundaries and detaining at least two people. If Trump’s actions were left unchallenged, the lawyers argued that “leading vast and unprecedented changes in the role of the military in our society.”
But Trump administration lawyers argued that the military protected federal agents and remained within legal restrictions.
The administration’s lawyers tried to show that the military had acted solely to protect federal agents from recognized threats and remained within legal restrictions. At the time of trial, the military was providing safety during an assault on a marijuana farm outside of Los Angeles.
