WASHINGTON – Prosecutors accused the DC man of arresting him on video throwing sandwiches at federal agents for a misdemeanor crime after failing to persuade the big ju judge to return a more serious felony charge against him.
Shawn Charles Dan, whose sub-chucking has made him a symbol of protest against President Donald Trump’s criminal crackdown in the country’s capital, is currently being charged with simple attacks, familiar told USA Today.
Unlike the felony accused initially filed, misdemeanor charges do not require the prosecutor to go to a large ju trial and obtain approval. Misdemeanor charges can be carried back to the bar for up to a year, the person said.
The case is one of several Justice Department prosecutors attempted to file felony charges against protesters in support of the Trump administration’s claims that they wanted to actively prosecute violence against law enforcement officials.
Janine Piro, the top federal prosecutor in Trump’s District of Columbia, promoted her efforts to accus Dan of a felony, saying in a social media video, “There we’ll stick a subway sandwich somewhere else.”
However, the large ju trial did not believe there was sufficient evidence to justify the felony charges and instead issued “no bill.”
Piro’s office did not comment on Dan’s incident. Dan’s lawyer also had no comment.
The District of Columbia’s U.S. Attorney’s Office attempted to claim a felony assault after he allegedly threw a Hoaggy-style sandwich wrapped in customs and border patrol agents during the August 10 confrontation.
“Why are you here? I don’t want you in my town!” Dan yelled at the police officers, according to a criminal charge reviewed by USA Today. He also vowed and vowed the officer as a “fascist,” the complaint said.
Dan then threw a sub-style sandwich on the officer’s chest, the complaint said. A video of the incident shared on social media shows a man in a pink shirt and screaming at the officers and throwing sandwiches to escape when federal agents chase him.
The felony charge of attacking federal law enforcement official Dan would have initially sentenced him to up to eight years behind bars.
After his arrest, the Department of Justice fired Dan from his job as an international affairs expert in the department’s criminal division.
At least one DC Federal Ju judge refused — three times — to indict a woman accused of assaulting an FBI agent, according to the Washington Post. A DC Magistrate also reported that another arrest in the northeast of the city followed “the most illegal search I’ve seen in my life.”
